ORDINANCE NO. 2022-02

AN ORDINANCE AMENDING SEC. 20-105, CHAPTER 20 - OFFENSES AND MISCELLANEOUS PROVISIONS OF THE LOG LANE VILLAGE MUNICIPAL CODE REGARDING FALSE STATEMENT; FALSE CREDENTIALS 

WHEREAS, the Town of Log Lane Village, has determined that there is a need to address the illegal activity of individuals under the age of twenty-one years entering the premises of marijuana establishments. enterprises and facilities; and 
WHEREAS, the Board of Trustees has determined that it is appropriate to modify the Log Lane Village Municipal Code, Chapter 20, Sec. 20-105 False statement; false credentials to include underage individuals entering marijuana establishments, enterprises and facilities. 


NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF LOG LANE VILLAGE, COLORADO AS FOLLOWS: 


Section 1. Amendment of Sec. 20-105, Chapter 20 - Offenses and Miscellaneous Provisions of the Log Lane Village Municipal Code - False statement; false credentials currently reads as follows: 

It shall be unlawful for any person under the lawful or qualified age specified in any provision of law to make false statements or to furnish, present, or exhibit any fictitious or false registration card, identification card, or note or other document for any unlawful purpose, or to furnish, present, or exhibit such document or documents issued to a person other than the one presenting the same for the purpose of gaining admission to prohibited places or for the purpose of procuring the sale, gift, or delivery of prohibited articles, including beer, liquor, wine, or fermented malt beverages (3.2 beer).

Sec. 20-105, Chapter 20 is deleted as it currently reads and is replaced by the following: 

It shall be unlawful for any person under the lawful or qualified age specified in any provision of law to make false statements or to furnish, present, or exhibit any fictitious or false registration card, identification card, or note or other document for any unlawful purpose, or to furnish, present, or exhibit such document or documents issued to a person other than the one presenting the same for the purpose of gaining admission to prohibited places or for the purpose of procuring the sale, gift, or delivery of prohibited articles, including beer, liquor, wine, or fermented malt beverages (3.2 beer) or for the purpose of entering a marijuana establishment, marijuana enterprise or marijuana facility for any purpose. 

Section 2. Penalties. A penalty assessment with a fine of $150.00 or a summons may be issued for the first offense at the discretion of law enforcement. Any subsequent offenses shall be issued a summons. Any person convicted of any violation of this ordinance may be punished by a fine between $150.00 and $2,650.00. 


Section 3. Severability. Should any section, clause, sentence or part of this ordinance be adjudged by a court of competent jurisdiction to be unconstitutional, and or invalid, such adjudication shall not affect the validity of the ordinance as a whole or any part thereof other than the part so declared to be unconstitutional or invalid. 


Section 4. Effective Date. This Ordinance shall take effect thirty (30) days after publication as required by law.
