AN ORDINANCE AMENDING ARTICLE III – GOLF CARS AND OFF HIGHWAY VIHCLES OF CHAPTER 16 – MOTOR VEHICLES AND TRAFFIC OF THE LOG LANE VILLAGE MUNICIPAL CODE TO INCLUDE ELECTRIC ASSISTED BICYCLES AND ELECTRIC SCOOTERS
WHEREAS, the Town of Log Lane Village, has determined that there is a need to include information regarding electric assisted bicycles and electric scooters in the Log Lane Municipal Code; and
WHEREAS, the Board of Trustees has determined that it is appropriate to amend Article III, Golf Cars and Off Highway Vehicles of the Log Lane Village Municipal Code, Chapter 16 Motor Vehicles and Traffic, to include the addition of electric assisted bicycles and electric scooters;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF LOG LANE VILLAGE, COLORADO AS FOLLOWS:
Section 1. Amendment of Sec. 16-40 Definitions, Article III – Golf Cars and Off Highway Vehicles, Chapter 16 – Motor Vehicles and Traffic of the Log Lane Village Municipal Code shall be amended to include the following:
Electric Assisted Bicycle A vehicle having two (2) or three (3) wheels fully operable pedals, and an electric motor not exceeding seven hundred fifty (750) watts of power.
Electric Scooter A device weighing less than one hundred (100) pounds with handlebars and an electric motor that is powered by an electric motor and that has a maximum speed of twenty (20) miles per hour on a paved level surface when powered solely by the electric motion. Electric scooter does not include an electrical assisted bicycle, electric personal assistance mobility device (EPAMD), motorcycle, or low-power scooter.
Section 2. Amendment of Sec. 16-41(a) Registration, Article III – Golf Cars and Off Highway Vehicles, Chapter 16 – Motor Vehicles and Traffic of the Log Lane Village Municipal Code currently reads as follows:
Sec. 16-41. – Registration.
No golf car, or OHV shall be operated on any town roadway without first being registered with the police department, on such form and with such information as shall be determined by the police. Upon registration, the OHV or golf car shall have affixed as evidence of the registration stickers on the front and rear of the vehicle. Such registration shall be reviewed annually in the same month in which first registered. The registration fee shall be $25.00 and may be adjusted in the future by a resolution of the board of trustees.
Sec. 16-41 (a) is deleted and is amended as it currently reads and is replaced by the following:
No golf car, OHV, electric assisted bicycle, or electric scooter shall be operated on any town roadway without first being registered with the police department, on such form and with such information as shall be determined by the police. Section 3. Amendment of Sec. 16-42 Operation of golf cars and OHV, Article III – Golf Cars and Off Highway Vehicles, Chapter 16 – Motor Vehicles and Traffic of the Log Lane Village Municipal Code currently reads as follows:
“Sec. 16-42. – Operation of golf cars and OHV.
Subject to the provisions of this article and except as prohibited herein, the operation of golf cars within the town’s corporate limits shall be permitted.”
Sec. 16-42. title and content is amended as it currently reads and is replaced by the following:
“Sec. 16-42. – Operation of golf cars, OHV, electric assisted bicycles and electric scooters.
Subject to the provisions of this article and except as prohibited herein, the operation of golf cars, OHV, electric assisted bicycles and electric scooters within the town’s corporate limits shall be permitted.”
Section 4. Amendment of Sec. 16-43 (a), (d), and (i), Article III – Golf Cars and Off Highway Vehicles, Chapter 16 – Motor Vehicles and Traffic of the Log Lane Village Municipal Code currently reads as follows:
(a) No golf car shall be operated by any person under the age of 14 years old and no OHV shall be operated by any person under the age of 16 years old.
(d) No golf car or OHV shall be operated on any sidewalk or pedestrian trail.
(i) The operator of a golf car or OHV shall obey all parking and traffic regulations that are applicable to motor vehicles and that have been adopted by the town.
Sec. 16-43 (a), (d) and (i) is deleted as it currently reads title and content is amended as it currently reads and is replaced by the following:
(a) No golf car shall be operated by any person under the age of 14 years old and no OHV, electric assisted bicycle or electric scooter shall be operated by any person under the age of 16 years old.
(d) No golf car, OHV, electric assisted bicycle or electric scooter shall be operated on any sidewalk or pedestrian trail.
(i) The operator of a golf car, OHV, or electric scooter shall obey all parking and traffic regulations that are applicable to motor vehicles and that have been adopted by the town.
Section 5. Severability. Should any section, clause, sentence or part of this ordinance be adjudged by a court of competent jurisdiction to be unconstitutional, and or invalid, such adjudication shall not affect the validity of the ordinance as a whole or any part thereof other than the part so declared to be unconstitutional or invalid.
Section 6. Effective Date. This Ordinance shall take effect thirty (30) days after publication as required by law.
