AN ORDINANCE AMENDING ARTICLE III - GOLF CARS AND OFF HIGHWAY VEHILCES OF CHAPTER 16 – MOTOR VEHICLES AND TRAFFIC OF THE LOG LANE VILLAGE MUNICIPAL CODE
WHEREAS, the Town of Log Lane Village, has determined that there is a need to amend the registration and restriction of golf cars and off highway vehicles (OHV); and
WHEREAS, the Board of Trustees has determined that it is appropriate to modify the Log Lane Village Municipal Code, Chapter 16 Motor Vehicles and Traffic, Article III Golf Cars and Off Highway Vehicles;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF LOG LANE VILLAGE, COLORADO AS FOLLOWS:
Section 1. Amendment of Sec. 16-40 Definitions Utility Type Vehicle (UTV) (6), Article III – Golf Cars and Off Highway Vehicles, Chapter 16 – Motor Vehicles and Traffic of the Log Lane Village Municipal Code currently reads as follows:
(6) Having side by side seating with a steering wheel for control.
Sec. 16-40 Definitions Utility Type Vehicle (UTV) (6), Article III, Chapter 16 is amended as it currently reads and is replaced by the following:
(6) Having seating with a steering wheel for control.
Section 2. Amendment of Sec. 16-41(a) and (c)(3), Article III – Golf Cars and Off Highway Vehicles, Chapter 16 – Motor Vehicles and Traffic of the Log Lane Village Municipal Code currently reads as follows:
(a) No golf car, or OHV shall be operated on any town roadway without first being registered with the marshal office, on such form and with such information as shall be determined by the marshal. Upon registration, the OHV or golf car shall have affixed as evidence of the registration stickers on the front and rear of the vehicle. Such registration shall be reviewed annually in the same month in which first registered. The registration fee shall be $25.00 and may be adjusted in the future by a resolution of the board of trustees.
(c) (3) Valid driver's license (a valid driver's license will be required to operate a golf car or OHV on the streets and alleys of the town).
Sec. 16-41(a) and (c)(3), Article III, Chapter 16 is amended as it currently reads and is replaced by the following:
(a) No golf car, or OHV shall be operated on any town roadway without first being registered with the police department, on such form and with such information as shall be determined by the police. Upon registration, the OHV or golf car shall have affixed as evidence of the registration stickers on the front and rear of the vehicle. Such registration shall be reviewed annually in the same month in which first registered. The registration fee shall be $25.00 and may be adjusted in the future by a resolution of the board of trustees.
(c) (3) Valid driver's license
Section 3. Amendment of Sec. 16-43 (a) and (b), Article III – Golf Cars and Off Highway Vehicles, Chapter 16 – Motor Vehicles and Traffic of the Log Lane Village Municipal Code currently reads as follows:
(a) No golf car or OHV shall be operated by any person under the age of 16 years old.
(b) No golf car of OHV shall be operated by any person unless such person has been legally issued and possesses a currently valid driver's license.
Sec. 16-43 (a) and (b) Article III, Chapter 16 is deleted as it currently reads and is replaced by the following:
(a) No golf car shall be operated by any person under the age of 14 years old and no OHV shall be operated by any person under the age of 16 years old.
(b) No golf car or OHV shall be operated without safety glasses being worn, unless there is a protective windshield, and a helmet being worn.
Section 4. Severability. Should any section, clause, sentence or part of this ordinance be adjudged by a court of competent jurisdiction to be unconstitutional, and or invalid, such adjudication shall not affect the validity of the ordinance as a whole or any part thereof other than the part so declared to be unconstitutional or invalid.
Section 5. Effective Date. This Ordinance shall take effect thirty (30) days after publication as required by law.
