ORDINANCE NO. 2022 __01_______

AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE TOWN OF LOG LANE VILLAGE, COLORADO, TO ADD A NEW CHAPTER 16-1, PROHIBITING PARKING MOTOR VEHICLES IN CERTAIN LOCATIONS WITHIN THE TOWN OF LOG LANE VILLAGE

                WHEREAS the Board of Trustees of the Town of Log Lane Village has found that parking of motor vehicles and equipment on unimproved portions of real property zoned as Residential (R-1), Residential (R-2), and Mobile Home Park (MH) causes diminution in property values, degradation of aesthetic appearance, poses risk of damage to underground utility infrastructure, and is adverse to public interests.

WHEREAS the Board of Trustees therefore finds it necessary and proper to prohibit parking of motor vehicles or equipment on unimproved portions of real property which is zoned as Residential (R-1), Residential (R-2), or Mobile Home Park (MH).

NOW THEREFORE BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF LOG LANE VILLAGE, COLORADO:

                That the following new Chapter 16-1 is hereby added to The Municipal Code of the Town of Log Lane Village:

“16-1 Parking of Vehicles on Residential and Mobile Home Property.

It shall be unlawful for any person to park, or to cause, suffer, permit, or allow the parking of any motor vehicle or equipment on any surface that is not a designated parking area on any lot which is zoned as Residential (R-1), Residential (R-2), or Mobile Home Park (MH).  It is presumed that the registered owner of the motor vehicle or equipment is the person who parked, caused, suffered, permitted, or allowed the parking of the motor vehicle or equipment parked in violation of this section.  The owner or person in possession of the real property on which such violation occurs is presumed to have allowed such violation.   

 

Persons desiring to park motor vehicles or equipment outside of a paved driveway on any lot which is zoned as Residential (R-1), Residential (R-2), or Mobile Home Park (MH) must apply for and obtain from the Board of Trustees prior approval and recognition of the proposed designated parking area.  

 

The term “designated parking area” means a paved driveway or other area approved by the Board of Trustees for the Town of Log Lane Village for parking motor vehicles and equipment. 

 

The term “equipment” means those vehicles, self-propelled or otherwise, which are not designed primarily for the transportation of persons or cargo over the public highways, and those motor vehicles which may have originally been designed for the transportation of persons or cargo over the public highways, and those motor vehicles which may have originally been designed for the transportation of persons or cargo but which have been redesigned or modified by the mounting thereon of special equipment or machinery, and which may be only incidentally operated or moved over the public highways. This definition includes but is not limited to wheeled vehicles commonly used in the construction, maintenance, and repair of roadways, the drilling of wells, and the digging of ditches.

 

The term “motor vehicle” means any self-propelled vehicle which is designed primarily for travel on the public highways and which is generally and commonly used to transport persons and property over the public highways, but the term does not include motorized bicycles, wheelchairs, or vehicles moved solely by human power. "Motor vehicle" includes a neighborhood electric vehicles, farm tractors, and off-highway vehicles operated on streets and highways.

 

Any person who violates this provision and is convicted may be punished according to Section 1-4-20.  Each day a violation of this provision continues shall constitute a separate offense.”
